New Criminal Law.
In the 75th year of independence, one more rule of the Britishers has ended. On 1st July 2024, a new law has come into force in the country. The law which has made justice its foundation by eliminating terrorism is the Indian Justice Code. This new criminal law has brought significant changes, and it is essential to understand how it will impact the lives of common people and what new provisions have been introduced. As of right now, the new law is operative.
Introduction of Terrorism Definition and FIR Registration: For the first time, terrorism has been defined in the Indian Judicial Code, giving the victim the right to register complaints anywhere. Even in cases of murder, robbery, and rape, FIRs can now be registered online, with a fixed time limit for FIR registration. This aims to streamline the process and ensure timely justice.
Strict Punishments and Opposition Response: The new law includes provisions for life imprisonment or even the death penalty for serious crimes like molestation. It also grants the right to confiscate the property of criminals. As soon as the new law was enacted, the opposition raised concerns, with some calling it a significant legal crisis and others deeming it a law brought in haste. Home Minister Amit Shah has addressed these allegations, stating that the new law will bring much-needed reforms to the Indian judiciary and criminal law system.
Shift from British-Era Laws to Indian Parliament’s Reforms: With the repeal of British-era laws, the Indian Parliament has introduced laws that emphasize justice over punishment, ensuring swift trials and protecting the rights of victims and complainants. This marks a significant shift from the previous system, which primarily focused on safeguarding the rights of the police.
